Terms & Conditions — Traxware Print

These Terms apply to quotations, design/CAD assistance, additive manufacture and related services supplied through or in connection with traxware-print.com.

1. What we provide

Traxware manufactures custom resin parts, prototypes and short runs to an agreed specification. Depending on the quotation, we may also provide CAD preparation, reconstruction of straightforward geometry, design suggestions, material suggestions, post-processing and shipping.

Unless expressly listed in the quotation, our service does not include engineering certification, regulatory approval, finite-element analysis, load testing, fatigue testing, chemical-compatibility testing, electrical certification, fire testing, food-contact certification, biocompatibility assessment or validation of the finished part in the customer’s complete system.

2. Inquiry, quotation and contract

Submitting an inquiry is not an order and does not bind either party.

A quotation may define the deliverables, quantity, material, nominal dimensions or tolerances where relevant, finish, price, VAT, shipping, estimated lead time and any assumptions or exclusions.

A contract is formed only when:

  1. the customer accepts the quotation or order summary in the manner requested by Traxware; and
  2. Traxware confirms acceptance, or begins performance where the quotation expressly provides that acceptance occurs in that way.

If an inquiry contains incomplete or conflicting information, Traxware may ask for clarification, revise the quotation or decline the work.

3. Customer specification and intended use

The customer is responsible for giving us enough accurate information to manufacture the requested part responsibly. This includes, where relevant:

Traxware may rely on information supplied by the customer. If relevant use conditions are omitted, inaccurate or changed after approval, the customer bears the risk that a part manufactured to the agreed specification may be unsuitable for the undisclosed or changed conditions, subject always to mandatory law.

4. Recommendations are not a fitness-for-purpose guarantee

We may recommend a resin, geometry change, wall thickness, orientation, insert, tolerance or other manufacturing approach. Such recommendations are based on the information available to us and are intended to assist the customer.

Unless Traxware expressly agrees in writing to a defined validation or performance requirement, a recommendation is not a certification, engineering approval or guarantee that the part is fit for the customer’s particular purpose.

The customer is responsible for:

5. Material properties and additive-manufacturing variation

Published resin datasheets normally describe test specimens produced and tested under defined conditions. Properties of an actual printed part can differ due to geometry, wall thickness, print orientation, support strategy, curing, post-processing, environment, ageing and repeated loading.

Unless a specific value and test method are expressly included in the quotation, values such as tensile strength, heat-deflection temperature, elongation, impact strength and chemical resistance are informative material-selection data, not guaranteed properties of the finished component.

Minor layer marks, support witness marks, colour variation and dimensional variation inherent to the agreed manufacturing process are not defects if the part remains within the agreed specification.

6. Safety-critical and regulated uses

The customer must tell us if a component is intended for a safety-critical or regulated function, including for example braking, steering, restraint systems, lifting people or loads, pressure containment, fire protection, mains-voltage safety, protective equipment, aviation, medical/life-support use, patient contact or another application where failure could reasonably cause serious harm.

Traxware may refuse such work or require a separately agreed validation scope. No acceptance of an inquiry, recommendation or quotation should be interpreted as regulatory approval.

Unless expressly agreed in writing, parts supplied by Traxware are not certified for safety-critical, medical, food-contact, pressure-retaining, fire-protection or similar regulated use.

7. Files, drawings and intellectual property

The customer warrants that it has the right to provide and use every CAD file, drawing, photograph, trademark, design and other material submitted to Traxware, and that manufacturing the requested item will not knowingly infringe third-party rights or applicable law.

The customer grants Traxware a limited licence to use submitted materials as necessary to evaluate, quote, manufacture, inspect, rework and deliver the order.

Customer-provided intellectual property remains the customer’s or its licensor’s property.

Unless the quotation expressly states otherwise:

Traxware will not publish customer files or project photographs for marketing without separate permission.

8. Original physical parts sent to us

Do not send an original part until Traxware confirms that it should be sent and provides shipping instructions.

The customer is responsible for packaging the item appropriately and for risk in transport to Traxware until delivered, except where mandatory law provides otherwise.

Customers should not send unique, irreplaceable or unusually valuable originals without first disclosing that fact and agreeing the handling and shipping method with Traxware.

Traxware will use reasonable care while an original is in its custody. For business customers only, and to the maximum extent permitted by law, liability for loss of or physical damage to an original part is limited to the documented replacement value or the amount expressly agreed before shipment, and excludes sentimental or consequential value.

9. Prices, VAT and payment

Prices are stated in the quotation and may be exclusive or inclusive of VAT as clearly indicated. Shipping, customs or special packaging are included only if stated.

Traxware may require full or partial prepayment, particularly for custom work, design work, new customers or material purchased specifically for an order.

Work may be paused if an agreed payment is overdue.

10. Lead times and delivery

Lead times are estimates unless expressly agreed as guaranteed. Additive manufacturing can require reprints because of print failure, post-processing or dimensional correction.

Traxware will inform the customer of material delays when reasonably possible. We are not responsible for carrier delays or events outside our reasonable control, subject to mandatory consumer rights.

Risk and delivery rules for consumers remain governed by mandatory applicable law.

11. Inspection, non-conformity and complaints

The customer should inspect the delivered parts as soon as reasonably possible.

If a part does not conform to the agreed specification, contact vjakes@traxware.co.uk with the order reference, description and photographs where useful.

For business customers, apparent defects should normally be reported within 10 business days of delivery; this period does not limit rights that cannot legally be limited.

Where Traxware is responsible for a non-conforming part, the usual remedy is, at our option and subject to mandatory law:

A part is not non-conforming merely because it is unsuitable for an application, operating condition or load that was not disclosed and not included in the agreed specification.

Nothing in this section restricts mandatory consumer rights concerning defective goods.

12. Custom-made goods and consumer withdrawal

Most parts supplied through Traxware Print are manufactured to the customer’s specifications or are clearly personalised. For such custom-made goods, the statutory 14-day withdrawal right for distance contracts generally does not apply.

Where a consumer purchases a separate service, such as CAD/design work, and asks us to start that service during an applicable withdrawal period, we may require the consumer’s express request to begin immediately and the acknowledgments required by law.

This section does not remove any withdrawal right that mandatory law actually grants for a particular order.

13. Liability — general

Traxware is responsible for performing the agreed manufacturing service with reasonable professional care and for delivering goods that conform to the agreed specification, subject to these Terms and mandatory law.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including mandatory liability for defective products, death or personal injury where applicable, fraud, intentional misconduct, gross negligence where it cannot be limited, or mandatory consumer rights.

14. Liability — business customers

For customers acting in the course of business, to the maximum extent permitted by law:

These limitations do not apply where the law prohibits them.

15. Prohibited or refused work

Traxware may refuse an inquiry or cancel an unperformed order where the requested manufacture appears unlawful, infringes third-party rights, involves prohibited weapons or dangerous items, misrepresents a certified/safety-critical status, or cannot in our reasonable view be manufactured responsibly with the agreed process.

If an accepted order is cancelled for such a reason, the customer remains responsible for work and non-recoverable costs already reasonably incurred, except where mandatory consumer law provides otherwise.

16. Confidentiality

Routine inquiries are handled with reasonable commercial confidentiality, but the website inquiry form is not a substitute for an NDA.

If a project is confidential, commercially sensitive or patent-sensitive, request an NDA before uploading sensitive design files. Traxware may agree a separate NDA where appropriate.

17. Personal data

Personal data are processed as described in the Privacy Policy. File uploads should not contain unnecessary personal data, medical records or other special-category personal data.

18. Changes to an order

Changes requested after approval may affect price, lead time and feasibility. Traxware may issue a revised quotation before implementing changes.

A prototype approval applies only to the approved revision. Customer changes after approval may require another prototype or validation.

19. Governing law and disputes

These Terms and contracts with Traxware are governed by the laws of the Czech Republic, without prejudice to mandatory rules that apply regardless of contractual choice.

For consumers, this choice does not deprive the consumer of mandatory protection available under the law that would apply under EU conflict-of-law rules, including where Traxware directs its activities to the consumer’s country of habitual residence.

The parties should first try to resolve complaints directly.

20. Severability and precedence

If any provision is invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

A specific written quotation or order specification prevails over these general Terms where the two conflict.
